A Managing Partner at Hafarizam Wan & Aisha Mubarak, and with 18 years of experience under his belt, Datuk Wan Azmir often handles prominent clients including politicians and celebrities including Malaysian actor Sharnaaz Adhmad, who was recently acquitted of punching a security guard.

What to do if you are ordered to ‘unlock’ your phone to be checked by a police officer?

  1. Ask them to show their ‘kad kuasa’ or authority card which shows their rank. This comes in four colours including blue, yellow, white, and red (suspended so they have no authority).
  2. Ask politely why they need to check your phone and what crime you are suspected of.
  3. If pressed, just hand over your phone and don’t resist them but make a police report afterwards if you feel that the officer accessed your phone without a valid reason.

Can you be forced into marriage if you are caught by Jabatan Agama Islam Selangor (JAIS) or Jabatan Agama Islam Wilayah (JAWI) in a hotel?

JAWI or JAIS are responsible for enforcing Syariah law relating to morality and religious transgressions in Malaysia. Unmarried couples who carry out sexual activities at a hotel or private location will be punished by law and will be required to attend counselling or moral rehabilitation programs by religious authorities. If caught by religious authorities, some couples may choose to get married to avoid action being taken against them even though it is not enforced by law.

Issue a letter of demand for the unpaid amount if you don’t have any summons pending in court. Make sure you have their full name according to their I.C., address, proof of loan, bank transaction receipt, online transfer, and proof of conversation.

Yes, it is! According to Datuk Wan Azmir, stalking involves a pattern of unwanted attention such as following, messaging, or persistent contact despite being told to stop. Cyberstalking, including online harassment and tracking of someone’s online activities, can also lead to legal action. Stalkers may face criminal charges including imprisonment, fines, or probation. Tips: if you’re a victim, document instances of stalking including dates, time, and evidence like messages or photos.
