Selangor Govt Considers Seizing Assets & Withholding Income of Husbands Who Evade Court-Ordered ‘Nafkah’
Husbands who evade and default on court-ordered ‘nafkah’ (financial support) payments may soon face stricter consequences, including asset seizure and income withholding, as the Selangor government moves to strengthen state laws and enforcement mechanisms.

According to a report by BERNAMA, Dr Mohammad Fahmi Ngah, Chairman of the State Islamic Religious Affairs and Cultural Innovation Committee, stated that additional proposed measures include garnishment orders, income retention, and the sale of property belonging to defaulters.
“The selection of an appropriate and efficient mechanism by the party seeking ‘nafkah’, especially the ex-wife or children’s guardian, is a crucial factor in ensuring successful enforcement of the orders."
"Failure to choose the right channel or mechanism can cause delays, confusion, and ultimately jeopardise the rights of the ‘nafkah’ recipient,” he said.
In addition, the Selangor government through the Syariah Judicial Department (JAKESS), is exploring collaborations with agencies such as the National Registration Department, Inland Revenue Board, and financial institutions to assist in tracing and seizing assets of individuals who have defaulted on court-ordered payments.

The Selangor Islamic Religious Council (MAIS), together with JAKESS, the Selangor Islamic Religious Department (JAIS), and Syariah legal experts, is currently reviewing and proposing amendments to the Islamic Family Law Enactment (Selangor State) 2003 to improve provisions related to the enforcement of maintenance orders.
For context, between 2022 and May 2025, the Selangor State Family Support Division received 1,189 complaints related to ‘nafkah’ violations.
